These Terms & Conditions ("Terms") govern your access to and use of the website operated by Lotus Packaging ("we," "us," or "our") at lotusplastics.com, as well as the purchase of products and services from Lotus Packaging. By accessing our website or placing an order with us, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website, requesting a quote, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you should not use our website or services.

These Terms apply to all visitors, customers, and business partners who access or use our website and services.

2. Products & Services

Lotus Packaging is a custom plastic bag manufacturer. Our products include, but are not limited to:

• Custom-printed T-shirt bags (HDPE and LDPE)
• Can liners and trash bags (commercial and industrial grade)
• Zip lock bags and resealable poly bags
• Flat poly bags and specialty packaging

Product descriptions, images, and specifications on our website are provided for general informational purposes. Actual products may vary slightly in color, dimensions, or appearance. Custom orders are manufactured to the specifications agreed upon between you and Lotus Packaging.

3. Quotes & Pricing

All quotes provided by Lotus Packaging are estimates and are subject to the following conditions:

• Quotes are valid for 30 days from the date of issue, unless otherwise stated in writing
• Pricing is based on the specifications, quantities, and materials discussed at the time of the quote
• We reserve the right to adjust pricing if raw material costs, shipping rates, or order specifications change before an order is confirmed
• Quotes do not constitute a binding contract until an order is formally accepted by Lotus Packaging in writing

4. Orders & Payment

All orders are subject to acceptance and confirmation by Lotus Packaging. We reserve the right to refuse or cancel any order at our discretion.

• Order Confirmation: An order is considered confirmed only after Lotus Packaging has issued a written order acknowledgment
• Minimum Orders: Certain products may be subject to minimum order quantities, which will be communicated at the time of quoting
• Payment Terms: Payment terms will be established at the time of order confirmation. Standard terms are net 30 days for approved accounts. New customers may be required to provide payment in advance or a deposit
• Late Payments: Past-due invoices may be subject to a late fee of 1.5% per month or the maximum rate permitted by law, whichever is less

5. Shipping & Delivery

Lotus Packaging ships products nationwide. The following terms apply to shipping and delivery:

• Estimated delivery dates are provided in good faith but are not guaranteed
• Shipping costs will be quoted separately and are the responsibility of the buyer unless otherwise agreed in writing
• Risk of loss or damage transfers to the buyer upon delivery to the carrier (FOB origin), unless otherwise specified
• Lotus Packaging is not responsible for delays caused by carriers, weather, natural disasters, or other circumstances beyond our reasonable control

6. Returns & Claims

Due to the custom nature of our products, the following return policies apply:

• Custom Orders: Custom-printed or custom-manufactured products are non-returnable and non-refundable unless they are defective or do not conform to the agreed-upon specifications
• Stock Items: Returns of unused stock items may be accepted within 30 days of delivery, subject to a restocking fee of up to 20%
• Damage Claims: Any claims for damaged or defective products must be reported in writing within 7 business days of delivery. Claims must include photos and a description of the issue
• Shortages: Any claims for quantity shortages must be reported within 7 business days of delivery

7. Warranty & Limitation of Liability

Lotus Packaging warrants that products will be manufactured in accordance with the agreed-upon specifications and will be free from material defects in workmanship.

Disclaimer: Except as expressly stated herein, all products are provided "as is." Lotus Packaging makes no other warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability: In no event shall Lotus Packaging be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the sale or use of our products. Our total liability for any claim shall not exceed the purchase price of the specific products giving rise to the claim.

8. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of Lotus Packaging or its content suppliers and is protected by U.S. and international intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent
• When you provide artwork, logos, or designs for custom printing, you represent and warrant that you have all necessary rights to use those materials and that they do not infringe upon any third-party intellectual property rights
• Lotus Packaging is not responsible for verifying the intellectual property rights of customer-supplied artwork

9. Indemnification

You agree to indemnify, defend, and hold harmless Lotus Packaging, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our website or services
• Your breach of these Terms
• Any claim that customer-supplied artwork, designs, or content infringes upon the intellectual property rights of a third party
• Your use or misuse of products purchased from Lotus Packaging

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Bond County, Illinois.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.

Lotus Packaging reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page, with an updated "Effective Date."
